General Terms and Conditions (GTC)

1. General Information
I, Christian Wagner of Quality Consulting Wagner, headquartered at Bodelschwinghstraße 28, 67227 Frankenthal, operate this website and the services offered herein. You can reach me at Kontakt@qualityconsulting-wagner.de.

The following terms apply to your use of the site, the booking of my services, and the execution of any projects.

2. Conclusion of Contract
A contract is concluded when you accept my offer or I confirm your booking in writing. Bookings made via the website are initially non-binding inquiries and become binding only after a preliminary meeting and my written confirmation.

Before we conclude a contract, I conduct a free initial consultation with you to define your requirements and the scope of services. Only afterward do I finalize the contract.

All services are provided remotely unless we expressly agree on an on-site appointment.

3. Description of Services
I offer project-based consulting services in quality management, including:

  • OEE implementation and process optimization

  • REFA time studies and analyses

  • Certification preparation according to ISO 9001 and IATF 16949

  • Failure analyses, limit-sample catalogs, and action planning

The exact scope of services will be agreed upon during the free initial consultation and recorded in a separate consulting agreement. The prices and services listed on the website are non-binding guidelines.

4. Prices and Payment Terms
All prices are net amounts plus the applicable statutory VAT.
The fee is set out in a binding offer before the start of the service.

Payment terms:

  • For OEE implementations and REFA time studies, full payment is due before services begin, as I provide proprietary materials (e.g., Excel spreadsheets).

  • For day-rate services (e.g., certification preparation), payment is due within 30 days of invoicing.

In the event of late payment, I charge default interest of 5 % above the base rate. After the third reminder, I reserve the right to initiate legal proceedings.

5. Cancellation and Right of Withdrawal
Cancellations must be submitted in writing by e-mail. Cancellations made at least 7 days before the start of services are free of charge. For later cancellations, I charge 50 % of the agreed fee.

Because my services are tailored individually and can begin immediately after contract conclusion, there is no right of withdrawal under § 356 (5) BGB. You agree that I may commence services immediately upon contract conclusion.

Cancellations after the start of services are not possible.

6. Confidentiality and Data Protection
I treat all information and data received in the course of our cooperation as strictly confidential. I use your data solely for the agreed purposes and do not pass it on to third parties.

Your data are processed in accordance with the EU General Data Protection Regulation (GDPR). For details, please see my Privacy Policy.

7. Liability
I am liable only in cases of intent or gross negligence.
I do not guarantee the success of implemented measures, as outcomes depend on internal factors within your company.
The results of my consulting services require the provision of correct and complete information by you. I accept no liability for damages resulting from incorrect client data, lack of cooperation, or other external factors.

8. Intellectual Property
All materials I provide (e.g., Excel spreadsheets, documentation) remain my intellectual property. You receive a simple, non-transferable right to use them internally only.

Passing on, selling, or publishing these materials to or with third parties is prohibited.

9. Final Provisions
German law applies. The place of jurisdiction is Frankenthal, provided you are a merchant under the German Commercial Code (HGB).
Should any provision of these T&Cs be invalid, the remaining provisions shall remain in force.
Amendments to these T&Cs shall apply only to new contracts and will be communicated to you in writing or by e-mail in advance.

Additional Note on Remote Services:
All services are performed remotely, eliminating travel expenses. Communication takes place via digital channels (e.g., Zoom, Teams, or e-mail).

Notice of Changes:
I reserve the right to amend these T&Cs at any time. Changes become effective upon publication on the website.
